YachtNav App

Terms of Use and License Agreement for YachtNav

These terms govern the use of the YachtNav app and the purchase of the nautical charts in the app. They are the end-user license agreement (EULA) of the app.

1. Provider and scope

The provider of the YachtNav app and the nautical charts is NAVISMARE Yachtlogistic, Apartado 5019, 8200-427 Guia, Portugal, email: (the “Provider”).

This agreement is concluded between you and the Provider only, not with Apple. It applies to the app and to the charts you buy in the app, and replaces Apple's standard license agreement for licensed applications. Apple's terms for the App Store apply in addition.

2. The app and its purpose

YachtNav is a navigation aid for pleasure craft (on iPad and iPhone; on the Mac for planning and the logbook). It does not replace official nautical charts and publications and does not satisfy any carriage requirement.

The base map (OpenStreetMap/OpenSeaMap) is not a nautical chart and contains no water depths. Course, speed, distance, ETA, fuel, tides and weather are approximate or forecast values and may differ from reality. AIS and NMEA data depend on the onboard equipment and replace neither lookout nor radar. Responsibility for the safe navigation of the vessel lies with the skipper.

3. License to the app

The Provider grants you a simple, non-transferable right to use the app on Apple devices that you own or control, as permitted by the usage rules of the App Store. Other accounts linked to the purchaser through Family Sharing or volume purchase may also use the app.

You may not copy (except for backup), modify, rent, lend or pass on the app, or reverse engineer its program code, unless the law mandatorily permits it. Rights not expressly granted to you here remain with the Provider. Map data, fonts and other third-party components are subject to their own licenses; sources and licenses are listed under Legal information (German and English).

4. Charts: what you buy

By purchasing you acquire a right to use the chart of one area in the edition stated at purchase (data date). The Provider derives the chart from data of official authorities; the chart information of the area names the authority.

The chart is not an official nautical chart, does not replace one, does not satisfy any carriage requirement and is not continuously corrected like an official product. The official authorities are not liable for the chart. For navigation, use it only together with current official charts.

5. Charts: right of use

The right to use the purchased edition is simple and not limited in time; the only restriction is the one in section 7. It applies to the devices linked to the Apple account with which you bought. Family Sharing is not enabled for charts. Backups of your device (iCloud, Mac) are permitted.

Not permitted are passing the charts or chart data on to third parties, extracting, converting or publishing the data, and removing source and safety notices. The data remain the property of the respective official authority.

6. Charts: updates

New editions of an area are included in the price for 12 months from purchase. After that you can buy each new edition individually as an update; the edition you bought remains usable. For areas in the USA, new editions are free of charge.

Updates that fix a security or display error in the edition you bought are available to you regardless.

7. Charts: downloading again

You can download purchased charts again via “Restore purchases” for as long as we offer the area in the shop. If we discontinue an area, we will announce it in the app at least three months in advance; charts already loaded remain usable.

8. Warranty

Your statutory rights in case of defects in digital products apply (sections 327 et seq. of the German Civil Code). Report defects to ; for a chart, state the area and the position at which you found the error.

9. Liability

We are liable without limit for intent and gross negligence, for damage from injury to life, body or health, under the German Product Liability Act and where we have given a guarantee. In cases of simple negligence we are liable only for breach of an essential contractual obligation (an obligation whose fulfillment is necessary for the proper performance of the contract and on which you may regularly rely), limited to the typical, foreseeable damage. Otherwise our liability is excluded. Responsibility for navigating the vessel remains with the skipper.

10. Withdrawal

As a consumer you have a 14-day right of withdrawal. For charts it lapses if at purchase you agreed that provision starts immediately and confirmed that you thereby lose your right of withdrawal. Apple carries out the purchase process and refunds (reportaproblem.apple.com).

11. Privacy and applicable law

Our Privacy Policy applies. German law applies; mandatory consumer protection provisions of the state in which you have your habitual residence remain unaffected.

12. Mandatory terms for Apple
